First The Bachelor break-up and now this.  

Shayne Lamas just can't seem to catch a break.  

E! News has learned exclusively that the 24-year-old Leave it to Lamas reality star was taken into custody on suspicion of DUI charges just after 1:00 a.m. Saturday morning in Venice, California. 

“Early Saturday morning, after consuming one drink, I willingly drove through a mandatory check point on my way home with complete confidence of passing," Lamas tells E! News exclusively. "However, the breathalyzer indicated that I was over the legal limit of blood alcohol content and was arrested onsite. I take full responsibility for my lack of judgment. I have always strived to be a role model for my friends, family and fans and have never nor will ever condone drinking and driving. I apologize for all those I have disappointed, including myself.” 

The reality star was released later that morning,after posting $9,000 bail. She's due in court Dec. 9 for the misdemeanor charge.

The paparazzo in the alleged Sean Penn scuffle is not taking his supposed altercation with the actor lying down. 

Photographer and documentarian Jordan Dawes told E! News exclusively that he filed a report against the Oscar winner for battery after the incident occurred Friday afternoon. 

"We can confirm that a battery report involving a member of the paparazzi was taken on Friday the 2nd at about 1:15 p.m. in the 300 block of Mesa Drive, but we are not confirming the names in the complaint," officer Karen Rayner of LAPD Media Relations said.

According to Dawes, he and four other photographers and videographers were waiting at the Brentwood Country Mart for the Milk star that afternoon. When Penn got out of his car, the photog started snapping pictures of the actor from his vehicle, which he claims was parked about 50 feet away from Penn. 

When Dawes got out of his car and started taking photos of Penn, that's when the photog said Penn approached him.

The big 4-0 never looked better. 

Gwen Stefani celebrated the advent of her fourth decade with friends and family at an intimate Saturday afternoon gathering at Cecconi's in West Hollywood.   

The ab-flaunting singer donned her signature red lipstick as she dined inside of the Italian restaurant with hubby Gavin Rossdale, sons Zuma and Kingston, BFF to the stars Kate Beckinsale and the actress' husband, director Len Wiseman. 

"There wasn't much gift-giving, but they did bring in a large bouquet of red roses, and as they were leaving, they stuffed some Mylar balloons in the backseat," an eyewitness told E!. 

"They are such a class act. They were so gracious with all of the photographers, and Gavin was even joking around, waving, and taking pictures on his iPhone as they left," says the source. "I think they chose to have the party in the afternoon because the kids were there." 

In spite of the party time, one partygoer was too tired for additional festivities. Little Zuma was spotted snoozing in his car seat next to the birthday girl as the family rode away in their black Range Rover.

Trouble at the Hoff's house.

Paramedics responded to a 911 call just before 3:30 p.m. Sunday at David Hasselhoff's digs in Encino, Calif.

"We sent an ambulance and a person was transported to a local hospital," says Brian Humphrey of the Los Angeles Fire Deparment. He declined to divulge the identity of the person or the reason for the hospitalization, citing privacy concerns. 

The 57-year-old America’s Got Talent judge has not shied away from discussing his struggles with alcoholism. He was hospitalized in for alcohol poisoning back in October 2007, just months after his daughter infamously videotaped him on the bathroom floor in the throes of a bender.

"Unfortunately, I did have a brief relapse, but part of recovery is relapse," the erstwhile Baywatcher said in a statement upon release of that tape. "I am a recovering alcoholic."

Jon and Kate Gosselin may have announced their independence from each other and the media recently, but that didn't stop the reality TV duo from having Fourth of July fireworks fun with their eight tykes.

The Gosselin brood brought out their sparklers Saturday evening—with one of the sextuplets donning a holiday-appropriate American flag shirt and shorts to celebrate. As the kids played, Jon spent an hour lighting fireworks in front of the ex-couple's home.

Jon was even spotted laughing with Kate at one point. An eyewitness tells E! News, "It's the first time I've seen Jon genuinely smile in a long time."

However, fans shouldn't get to excited for a reconciliation just yet.

Says the source, the holiday's events were "obviously for the kids."
