While Britney Spears tunes up for a new album and world tour, a lawyer for the reforming pop princess is telling the court she's not really up to handling a driver's license issue.

For what seems like the umpteenth time, attorney Michael Flanagan is seeking to derail a trial in the case of Spears and her MIA California driver's license.

He filed documents today in Los Angeles County Superior Court requesting a stay in the proceedings because she is remains under the control of a conservatorship.

"The Probate Court has found that [Spears] lacks the capacity to retain counsel," Flanagan writes, "as a result, [Spears] is currently unable to participate meaningfully in this matter." (View the documents.)

News hit last week that Sex and the City author Candace Bushnell will pen a series of books for the young adult audience following the iconic Carrie in her early years.

The author herself tells E! News she doesn’t mind Miley as a potential for Carrie Jr.

While Bill Maher gets a childlike delight in exposing right-wing agendas, don't expect him to procreate anytime soon.

Maher tried his hand at Emmy swagging this weekend, stopping by the Kari Feinstein Style Lounge in Beverly Hills. When men's clothing vendor ACDG offered the comic a charity T-shirt supporting a cause called Kids Among Stars, Maher glanced down at the piles of free goods in his hands, looked up and scoffed, "I hate kids."

No matter, as Seth Rogen is a big enough kid for all of us. Ladies chatting at the Reebok booth, visited by the likes of Balthazar Getty and Kristen Bell, had a dirty little tidbit about the Superbad scribe.

The sports line offers a customizable shoe called CustomRBK, wherein any star (or lowly pedestrian with cash or charge) can have a word up to nine characters stitched onto the back of their shoe. Rogen, apparently, broke the bank in expletives he tried to get past the sneaker censors.

"They kept returning his requested words, because they violated Reebok's service agreement," a source said. "He finally got away with EATPOO."

VMA performance or not, Miley Cyrus is pumped up for Britney Spears to do whatever she's doing at the MTV self-love fest this weekend.

Cyrus is in New York City, prepping for a huge gig at CBS' upcoming Condé Nast-sponsored Fashion Rocks charity concert featuring music legends and fashionistas to benefit cancer research. When popping out of a midtown rehearsal space yesterday, photogs asked Cyrus if she was looking forward to Spears' do-over.

"It will be awesome, I can't wait," she said.

David Arquette has found a new passion after the demise of his FX series Dirt—designing menswear.

Reports last week said the often outlandishly garbed Arquette will partner with equally eccentric singer Ben Harper on a collection called Propr (spelled correctly). And by spelled correctly we mean that this is the incorrect spelling David and Ben have chosen.

E! spotted Arquette out last night with wife Courteney Cox at Veuve Clicquot's fifth anniversary celebration for West Hollywood eatery Il Sole, where the actor and producer could speak of nothing but his forthcoming duds.

"David is so excited about his fashion line, its releasing next month," an onlooker said. "He was telling everyone about it, from guests to staff."

Brody Jenner enjoyed an extended 25th birthday celebration in Cabo San Lucas over the weekend with his Hills castmates in tow.

Jenner, along with Lauren Conrad and Audrina Patridge, reveled in all-night partying and daily beach lounging at the LG Villa, a private mansion in the Mexican resort town.

The trio, as well as Jenner’s buds Frankie Delgado and Doug Reinhardt, arrived Thurs., Aug.21—Brody’s actual birthday—and got down to some serious fun.

“They went bananas,” a source tells E! News. “They partied until about 3 a.m, cocktails, birthday cake, in and out of the pool.”

The two impresarios debut a never-before-heard track from Jay-Z’s anticipated forthcoming album, Blueprint 3, in which he implores the ladies out there: Keep your tops on, Beyoncé is in the house.
